Hardware (Mini-Studio)

1. Provision of Tool & Subscription Model.
The physical textile scanning enclosure (the "Hardware Tool") is provided strictly as an optional accessory to facilitate data collection and image ingestion for the [Software Name] platform (the "Service"). The Hardware Tool is an unpowered, low-voltage (5V DC) apparatus utilizing third-party industrial components.
1.1 Ownership and Return Conditions. The Hardware Tool is not sold and remains the sole and exclusive physical and intellectual property of the Company. Provision of the Tool grants the User only a revocable, non-exclusive license to utilize the hardware during an active Service subscription. Upon termination, expiration, or cancellation of the User's Service account, User shall immediately cease use of the Hardware Tool and return it to the Company in good working condition within thirty (30) business days. Failure to return the Hardware Tool shall result in an automatic hardware replacement fee.
2. Electrical Requirements, Modifications, & Best Practices.
To ensure data fidelity and hardware safety, User agrees to operate the Hardware Tool strictly in accordance with the following power configurations:
2.1 Primary Configuration: The Hardware Tool’s camera module and LED lighting strip should be connected directly to the host computer via separate native USB ports, or a single certified USB 3.0 (or higher) / USB-C port capable of delivering a minimum of 5V/1A of continuous current.
2.2 Secondary (Wall-Power) Configuration: In the event that the host computer features only a single legacy USB 2.0 port, User must connect the camera module directly to the computer’s USB port and connect the LED lighting strip independently to an external power source.
2.3 No Unauthorized Modifications: User shall not modify, tamper with, alter, or disassemble the internal wiring, circuit boards, 3D-printed structural components, or hardware configurations of the Hardware Tool. Any unauthorized modifications shall void all software support obligations and immediately terminate the Company's obligation to ensure hardware or software compatibility.
3. Third-Party Power Sources & Indemnification.
If User utilizes the Secondary Configuration (Wall-Power), User is strictly required to power the LED lighting strip using a commercially manufactured, certified 5-Volt DC USB power adapter (e.g., a certified smartphone charging block) that bears valid regional safety marks including, but not limited to, UL, CSA, FCC, or CE.
The Company does not manufacture, test, or supply AC wall-power adapters. The selection, safety, maintenance, and operation of any third-party power adapter or electrical outlet used in conjunction with the Hardware Tool is the sole responsibility of the User.
The Company expressly disclaims all liability for any property damage, electrical faults, device failures, or personal injury resulting from the use of uncertified, faulty, or third-party AC wall adapters or electrical outlets. User agrees to indemnify and hold the Company harmless from any claims arising from the User's choice or use of such third-party power components.
4. Manual Illumination & Variable Mechanical Height Calibration.
User acknowledges that the Hardware Tool utilizes an adjustable multi-position mechanical chassis and an integrated lighting array to accommodate various textile structures and densities. To prevent image degradation, focus softening, or structural exposure errors, User agrees to adhere to the following operational parameters:
4.1 Preset Calibration Compliance: User agrees to configure the physical height mechanism and the illumination dimmer thresholds strictly in accordance with the provided presets outlined within the Service application UI prompts for each respective fabric profile.
4.2 Material Placement and Position Verification: User is solely responsible for ensuring that all textile samples are pulled completely flat, centered, and smoothed across the target scanning surface. User must verify that the physical adjustable height mechanism is completely seated, settled, and securely locked into its designated operational height endpoint matching the chosen fabric profile.
4.3 Disclaimer of Analysis Errors: The Company assumes zero responsibility for inaccurate software analysis, miscalculated yarn spacing, data distortions, or processing failures resulting from wrinkled fabric samples, unsecured or shifting mechanics, or User's failure to manually calibrate the physical scanning environment according to the in-app prompts.
5. Limitation of Liability & Environmental Conditions.
To the maximum extent permitted by applicable law, the Hardware Tool is provided "as is" without warranties of any kind, either express or implied, including warranties of durability or fitness for a particular purpose. User agrees to operate and store the Hardware Tool in a dry, indoor environment free from extreme temperatures, high humidity, or industrial steam that could cause mechanical misalignment or electronic failure.
In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of the physical handling, improper connection, or deployment of the Hardware Tool within User's business environment. Nothing in these terms shall exclude or limit the Company's liability for death, personal injury, or any other liability that cannot be excluded or restricted under the public order laws of Quebec or Canada.
